Can my partner join me in Toowoomba on a partner visa while I am on a 494 regional visa?

Yes. If you are in Australia on a 494 or any other substantive visa, your partner can apply for an onshore partner visa (820/801) provided you are the sponsor and the relationship is genuine. The partner will receive a bridging visa at lodgement. The partner visa is not a regional visa, it does not require your partner to remain in Toowoomba. However, if you are on a 494 and must remain in the regional area, your partner’s ability to live elsewhere may be limited by practical considerations.

How long does a partner visa take when applying from Toowoomba?

Processing times are national, the Department does not have a separate Toowoomba queue. Onshore applications are currently taking over 12 months for the temporary stage. The best way to manage this is a complete, well-evidenced application lodged as early as possible in the relationship.

What evidence is particularly useful for a Toowoomba couple's partner visa?

If your partner is currently outside Australia, the appropriate pathway is an offshore partner visa (subclass 309 temporary, leading to subclass 100 permanent). Your partner applies from their country of residence and can come to Australia on a different visa (such as a visitor visa) while the partner visa is being processed, provided they depart before any conditions require it. The offshore pathway takes longer than the onshore pathway, we advise on the strategic timing at the consultation stage.

Can a de facto relationship qualify for a partner visa in Toowoomba?

Yes. De facto couples, including same-sex couples, are eligible for the partner visa. The relationship must have been ongoing for at least 12 months before lodgement unless there are compelling circumstances. Evidence requirements are the same as for married couples. The 12-month requirement does not apply if you are registered in a state or territory relationship register.
